Trump Administration Orders Jeffco Schools to Reverse Transgender Policies

The U.S. Department of Education has directed Jeffco Public Schools in Colorado to amend its policies regarding transgender students, specifically those that permit these students to participate in girls’ sports and access female restrooms. The order was issued on March 15, 2024, following the Department’s conclusion that the school district violated Title IX of the Education Amendments of 1972. The Department’s investigation revealed that male students potentially occupied up to 61 roster positions on girls’ sports teams.

Assistant Secretary for Civil Rights Kimberly Richey stated, “Today’s findings reveal sweeping Title IX violations by Jefferson County Public Schools—denying fairness and equality to female students by allowing males into their private facilities, overnight accommodations, and athletics.” The Department has granted Jeffco Public Schools a period of 10 days to comply with a proposed resolution, which includes revising its current policies and publicly affirming its commitment to Title IX.

The Department’s scrutiny of Jeffco Public Schools began after a report surfaced in June of the previous year, highlighting concerns over the school district’s sleeping arrangements for transgender students during overnight trips. According to the district’s policy, transgender students should be assigned accommodations based on their gender identity. This approach aims to address the needs of transgender students on a case-by-case basis, with considerations for their safety, comfort, and social integration.

Concerns were raised regarding the district’s communication with parents about its policies. The Department noted that Jeffco allegedly misled parents by stating that boys and girls would be separated for overnight accommodations, without clarifying that its definition of “girl” extends to boys who identify as female.

A spokesperson for Jeffco Public Schools previously asserted that the district’s policies align with Colorado’s anti-discrimination laws, which stipulate that transgender individuals are entitled to use facilities consistent with their gender identity. As of now, the school district has not responded to inquiries regarding the recent Department of Education announcement.

This situation marks the second investigation into a significant Colorado school district concerning Title IX since the onset of the Trump administration. In January of last year, the Department initiated an investigation into Denver Public Schools after the district implemented an all-gender restroom policy at East High School. Subsequently, the Department mandated a return to single-sex facilities, contending that the all-gender restrooms discriminated against girls.

In response to the findings, Denver Public Schools Superintendent Dr. Alex Marrero expressed his commitment to protecting students from what he described as a “hostile administration.” He criticized the U.S. Department of Education for its stance, asserting that the all-gender facilities did not harm female students.

Richey emphasized the urgency for Jeffco Public Schools to act, calling the policies “unconscionable” and prioritizing gender identity over equal access for female students. She added, “The Trump Administration will not relent until female athletes’ safety, opportunities, and equal protection under the law are fully restored.”
